Agreement Between Client and MKDigitalMarket

These Terms and Conditions govern your use of MKDigitalMarket's design services and constitute a legal agreement between you (the "Client") and Mukesh Kumar operating as MKDigitalMarket (the "Designer").

By engaging our services, you acknowledge that you have read, understood, and agree to be bound by these terms. If you disagree with any part of these terms, you must not use our services.

Acceptance of Terms

By accessing and using MKDigitalMarket services, you accept these terms
You must be at least 18 years old to use our services
Continued use constitutes ongoing acceptance of these terms
We reserve the right to modify terms at any time
It is your responsibility to review terms periodically

Payment Terms

50% advance payment required to start any project
Remaining 50% due upon project completion
Payment methods: Bank Transfer, UPI, Online Payment
All prices are in Indian Rupees (INR)
Taxes additional as applicable

Service Agreement

Detailed project scope defined in initial consultation
Timelines mutually agreed upon before project start
Client approvals required at each milestone
Revisions limited as per chosen package
Additional work billed separately

Intellectual Property

Final designs become client property after full payment
We retain right to showcase work in portfolio
Source files provided upon request (additional charges may apply)
Client warrants they own all provided content
Third-party assets must be properly licensed

Limitations & Liability

We are not liable for indirect or consequential damages
Maximum liability limited to project fee
Not responsible for third-party platform changes
No guarantees on specific business outcomes
Force majeure events may affect timelines

Dispute Resolution

Attempt mediation before legal action
Jurisdiction: Delhi courts, India
30-day notice period for dispute escalation
Documentation required for all claims
Mutual negotiation encouraged

Any work beyond agreed scope will be quoted separately

Timelines

Delays in client feedback extend project completion dates

Client responsible for providing all text and images

Website hosting and domain not included unless specified

Support

30 days free support included after project completion

Updates

Content updates billed separately as maintenance

Standard Project Process

1. Consultation & Quote

Initial discussion to understand requirements, followed by detailed quote submission. Quote valid for 30 days.

2. Agreement & Payment

Client accepts quote, signs agreement, and makes 50% advance payment to start project.

3. Design & Development

Project execution with regular updates and milestone approvals from client.

4. Review & Revisions

Client reviews deliverables and requests revisions as per agreed package.

5. Final Delivery

Final payment received, all files delivered, and project marked complete.

Additional Legal Clauses

Indemnification

Client agrees to indemnify and hold harmless MKDigitalMarket from any claims, damages, or expenses arising from client-provided content or misuse of delivered designs.

Termination

Either party may terminate services with 7 days written notice. Work completed up to termination date will be billed proportionally.

Governing Law

These terms are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of courts in Delhi.

Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
